Booking Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS BEFORE MAKING A BOOKING.

By paying your deposit and completing a booking with The Shift Studio, you confirm that you have read, understood and agree to these terms and conditions in full. These terms form a legally binding agreement between you and Nurtured Shift Studio Ltd.

References to "we", "us" and "our" in these terms refer to Nurtured Shift Studio Ltd. References to "you" and "your" refer to the person or business making the booking.

To make a booking at The Shift Studio you must:

• Be aged 18 or over
• Provide accurate and complete information when making your booking
• Pay the full hire fee at the time of booking
• Agree to these terms and conditions in full
• Session times
  Morning 9am–1pm
  Afternoon 2pm–6pm
  Evening 6:30pm - 9:30pm (Monday–Friday only). 
• Weekend bookings are available for morning and afternoon sessions only.
• Your booking is not confirmed until we have received your deposit and sent you a written booking confirmation by email. 
• We reserve the right to decline any booking at our absolute discretion.
• It is your responsibility to ensure that all booking details, including the date, time, space and duration are correct before paying your deposit. 

PAYMENT

• Full payment on booking  - 100% of the hire fee is due at the time of booking. Your booking is not confirmed until payment is received in full.
• Transfers (14+ days notice) with more than 14 days notice, payment can be transferred to an alternative available date. Each booking may only be transferred once.

All payments must be made by the methods specified at the time of booking. All prices are quoted in pounds sterling (£) and are inclusive of any applicable taxes unless otherwise stated.

All payments are non-refundable. In the event of cancellation, no refund will be given. If you cancel with more than 14 days notice, your payment may be transferred to an alternative available date, subject to availability.

Founding Member Rates: Our current introductory rates are available for a limited time only. We reserve the right to update our pricing at any time. Any confirmed bookings will be honoured at the rate agreed at the time of booking.

We understand that plans can change. Our cancellation policy is as follows:

• All payments are non-refundable in all circumstances, regardless of when you cancel.
• Cancellations with more than 14 days notice - your payment may be transferred to an alternative available date, subject to availability. Each booking may only be transferred once.
• Cancellations within 14 days of your hire date - no transfer or refund will be given. The full hire fee is forfeited.
• No shows on the day - the full hire fee is forfeited with no refund or transfer.
• All cancellations must be made in writing to info@theshiftstudio.co.uk.
• Cancellations are effective from the date and time we receive your written notification.

Please note: We strongly recommend that hirers take out their own cancellation or event insurance to protect against unforeseen circumstances that may prevent you from attending your booking.

We are happy to transfer your payment to an alternative available date, subject to the following conditions:

• Transfer requests must be made in writing to info@theshiftstudiosobo.co.uk with a minimum of 14 days notice before your original hire date
• Transfers are subject to availability - we cannot guarantee that your preferred alternative date will be available
• Each booking may only be transferred once - a second request to change date will not be accommodated and no refund will be given
• Transfer requests made within 14 days of your hire date cannot be accommodated and the full hire fee will be forfeited.

In the unlikely event that we need to cancel your booking, we will notify you as soon as possible and will offer you the choice of:

• A full refund of all monies paid or
• An alternative date at no extra charge, subject to availability

Our liability to you in the event of cancellation by us is limited to a full refund of monies paid. 

We are not responsible for any consequential losses you may incur such as travel costs, equipment hire or lost income.

USE OF THE SPACE

When you hire a space at The Shift Studio you agree to the following conditions of use:

• Arrival & Departure - Please arrive no earlier than your booked start time and vacate the space by your booked end time. Late departure may result in additional charges.
• Condition of the Space - You must leave the space in the same clean and tidy condition as you found it. You are responsible for removing all of your own rubbish and belongings.
• Permitted Use - The space must only be used for legal, reasonable and community-minded activities. We reserve the right to refuse entry or end a hire if we consider the use to be inappropriate.
• Capacity - You must not exceed the maximum capacity of the space as notified to you at the time of booking. Overcrowding is a health and safety risk.
• Alcohol & Substances - The sale or consumption of alcohol on the premises is not permitted without our prior written consent. Illegal substances are strictly prohibited at all times.
• Smoking - Smoking, vaping and the use of e-cigarettes is strictly prohibited inside the studio at all times. This includes all areas of the premises.
• Noise - Please be mindful of neighbouring businesses and residents. Excessive noise that causes disruption to others may result in your hire being terminated without refund.
• Security - You are responsible for the security of your belongings during your hire. The Shift Studio accepts no liability for loss or theft of personal property on the premises.

We reserve the right to terminate a hire immediately and without refund if these conditions are not met or if we consider the behaviour of the hirer or their guests to pose a risk to the safety of the premises, other hirers or staff.

You are responsible for any damage caused to the premises, fixtures, fittings or equipment during your hire period - whether caused by you, your clients, guests or any other person attending under your booking.

Any damage must be reported to us immediately. 

We reserve the right to charge you the full cost of repair or replacement for any damage caused during your hire. 

We will provide you with evidence of the cost before charging.

We recommend that hirers hold appropriate public liability insurance to cover damage and third party claims arising from their activities at the studio.

The Shift Studio holds public liability insurance for the premises. However, this does not cover your activities, equipment or the activities of your clients and guests.

We strongly recommend that all hirers hold their own public liability insurance appropriate to their activities. 

Certain types of session - particularly those involving physical activity, therapies, or large numbers of attendees - may require specific cover.

By making a booking you confirm that you hold all necessary insurance required for the activities you intend to carry out at the studio.

For therapists, coaches and wellbeing practitioners: please ensure your professional indemnity and public liability insurance covers you for activities carried out at hired premises. 

The Shift Studio warmly welcomes sessions and activities involving children and young people - this is at the very heart of what we do. 

However, the following conditions apply:

• The hirer is responsible for the safeguarding and supervision of all children and young people attending their session at all times
• Where your session involves working with children or young people under 18, you must hold a current and valid DBS (Disclosure and Barring Service) check and any other relevant qualifications or certifications required by law
• You must comply with all relevant safeguarding legislation and best practice guidelines
• The Shift Studio accepts no responsibility for the safeguarding of children attending sessions run by third party hirers 

The Shift Studio takes all reasonable steps to ensure the premises are safe and fit for use. However, to the fullest extent permitted by law:

• We accept no liability for any loss, injury or damage suffered by you, your clients or guests during your hire, except where caused by our own negligence
• We are not liable for any indirect or consequential loss, including lost income, lost opportunity or reputational damage
• Our total liability to you in connection with any booking shall not exceed the total hire fee paid by you for that booking
• We are not responsible for loss or damage to any equipment, props or personal belongings brought onto the premises by you or your guests

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be excluded by law.

You are welcome to take photographs and film content within the space during your hire for your own personal or business use. 

However:

• You must obtain the consent of any individuals who appear in photographs or footage before publishing or sharing that content
• You must not photograph or film other hirers or their clients without their explicit consent
• We would love to see your content- please tag us @theshiftstudio_sobo and use #theshiftstudio when sharing on social media
• We may occasionally photograph or film the studio for our own marketing purposes. 
• We will always ask for your permission before including you or your clients in any content we publish 

The Shift Studio operates three distinct hire spaces. 

The following conditions apply when booking multiple zones:

• A maximum of two zones may be booked simultaneously unless you have booked exclusive use of the whole studio gives you access to all three zones for the duration of your hire and guarantees complete privacy
• You must remain within the zone or zones you have booked and may not use other areas of the studio without prior agreement 

• Governing law. These terms and conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales
• Changes to these terms. We reserve the right to update these terms and conditions at any time. The most recent version will always be available on our website. Any bookings made before an update will be governed by the terms in place at the time of booking.
• Entire agreement. These terms and conditions, together with your booking confirmation and our cancellation policy, constitute the entire agreement between you and The Shift Studio in relation to your hire.
• Severability. If any part of these terms is found to be unenforceable, the remaining terms will continue to apply in full.
• No waiver. Any failure by us to enforce these terms on any occasion does not constitute a waiver of our right to enforce them on a future occasion.

YOUR AGREEMENT

By making payment in full and completing a booking with The Shift Studio, you confirm that you are aged 18 or over, that you have read and understood these terms and conditions in full, and that you agree to be bound by them. 

These terms form a legally binding agreement between you and Nurtured Shift Studio Ltd.
